Terms and Conditions for Use of Services in Foreign Language (English)

Sony Bank (“Company”) operates a website and account opening application software in English (“English Banking Service”) for improving the convenience of foreign customers residing in Japan (“customer”). The customer shall read and agree to these terms and conditions for use before using the English Banking Service.

Article 1 - Transaction Method
  • The customer shall use the English Banking Service in accordance with the transaction method set forth below:
    • The customer shall use a computer terminal which enables to connect with the Internet.
    • A procedure may be performed by delivering the relevant documents by postal mail.
    • The customer shall use an automated teller machine of financial institutions which are affiliated with the Company.
    • For Visa Debit transactions, the customer shall confirm the “Terms and Conditions for Sony Bank Visa Debit Agreement”.
  • The Company does not accept inquiries by telephone in English. If the customer wishes to make an inquiry in English, he/she must use the “real chat” or email on the English website.
    Information with respect to business days and response times for inquiries in English is available on the Company’s website.
  • The customer may be required to enter or submit an application in Japanese for a transaction or procedure.
  • Account Opening Application Software
    The Account Opening Application Software means dedicated software which is installed on a computer terminal which enables the customer to connect to and browse the Internet and to use the service.
    • The customer may not use the Account Opening Application Software overseas. The customer shall use the Application within Japan.
    • The customer at the age of 20 or above may open the account using the Account Opening Application Software. If the customer is under the age of 20, he/she shall apply for the account opening from the Japanese website.
    • For the account opening procedures of the Company, the customer shall upload the required documents using the relevant functions of the Application in order to confirm that the conditions of use are met.
    • If the customer fails to meet the conditions of use or the Company is unable to confirm that the customer meets the conditions of use, the Company shall cancel the application for account opening.
    • If any information reported by the customer differs from the required documents or is insufficient, the Company may correct or add information based on the information described in the documents and open the account for the customer.
      The Company shall not be liable for losses (such as transfer errors, etc.) due to information correction made by the Company.
    • If it is less than six months since the customer entered Japan, documents in which the customer’s workplace is described will be requested in order to confirm that the customer works at a business location in Japan.
  • English Website
    It means the website in English for introduction of the products or transaction of the services which the Company provides.
    • The website may not operate properly depending on the type of computer terminal connected to the website, browser, OS, or version of OS.
    • The products and services provided on the English website are limited in comparison with those provided on the Japanese website.
Article 2 - Limitation on Transactions
The English Banking Service which the Company provides is limited to a part of all of the various types of services and transactions which the Company handles (including terms and conditions, etc., as well as various types of notifications, inquiries and other communications).
The services which the customer can transact in English are described in the menu displayed on the English website.
Article 3 - At Time of Departure from Japan
  • The Company specifies in Article 3 “How to Open Account” of Sony Bank General Terms and Conditions that the customer who is eligible to open his/her account shall be limited to individuals residing in Japan (which means a resident set forth in the “Foreign Exchange and Foreign Trade Act”). The customer may not conduct any transaction outside Japan. If the customer departs from Japan, the customer shall promptly close the account of the Company.
  • If the customer has a deposit balance when he/she closes his/her account of the Company, the customer shall transfer the balance into the account of any other financial institution in Japan in the name of the customer him/herself. The customer may not remit the balance to any overseas financial institution.
  • If the customer does not have an account with any other financial institution in Japan and declares that he/she does not require a deposit, the Company may close the customer’s account.
Article 4 - Prohibited Matters
The account of the Company shall not be lent, transferred, or sold to any third party. The account shall be used by the account holder him/herself. If any person other than the customer is suspected of using the customer’s account, the Company may suspend all or a part of the transactions or close the transaction account.
Article 5 - Report and Explanation
  • The Company may request that the customer submits various types of confirmation or documents periodically or by specifying the submission deadline in order to properly understand the customer information and specific content of the transactions, etc. If the customer fails to respond to such Company’s request by the specified deadline without reasonable grounds, the Company may suspend all or a part of the customer’s transactions or close the customer’s transaction account.
  • Taking into consideration the customer’s response to the Company’s request for various types of confirmation and submission of the documents, specific content of the transactions, an explanation by the customer and any other circumstances, if the Company determines that there is a risk of money laundering, terrorist financing or conflict with economic sanctions-related laws and regulations, the Company may suspend all or a part of the customer’s transactions or close the customer’s transaction account.
  • Concerning any restrictions on transactions, etc., implemented by the Company, if the Company determines that the risk of money laundering, terrorist financing or conflict with economic sanctions-related laws and regulations has been eliminated, the Company will lift the restrictions on transactions, etc.
  • The Company shall not be liable for losses due to the above-mentioned restrictions on transactions, etc.
Article 6 - Mutatis Mutandis Application of Other Terms and Conditions
Concerning any matters related to the transactions with the Company that are not specified in these Terms and Conditions, Sony Bank General Terms and Conditions, Terms and Conditions for Smartphone Application Software and other applicable terms and conditions for each transaction shall apply mutatis mutandis. The Company’s terms and conditions are available on its English website or Japanese website.
Article 7 - Modification of these Terms and Conditions
  • The Company may modify these Terms and Conditions and other conditions in the event that changes in financial situations or other reasonable grounds are deemed. The Company will provide notification of the modification by posting relevant information on the Sony Bank's website in English or on the Sony Bank's website in Japanese or by other appropriate means.
  • The modifications in the preceding paragraph shall be applied from the commencing date of application set forth at the Company's notification, etc.
Article 8 - Modification of English Banking Service
The Company may modify the content of the English Banking Service. If the Company makes any modification which has a significant impact on the customer, the Company shall inform the customer thereof on the English website.
Article 9 - Governing Law, Jurisdiction and Language
  • These Terms and Conditions and all transactions that take place pursuant hereto shall be governed by and construed in accordance with the laws of Japan. If a need arises to file a lawsuit concerning any transaction executed pursuant hereto, it shall be submitted to the exclusive jurisdiction of the Tokyo District Court.
  • The Company provides the English Banking Service and the English information related to the respective terms and conditions. However, only the official Japanese text shall have legal effect as a contract.
